1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "Player," "you," or "your") and kuyaph ("we," "us," "our," or "the Platform"), governing your access to and use of the kuyaph gaming platform, including all associated websites, mobile applications, services, and content (collectively, the "Services"). By creating an account, accessing the Platform, or using any Services provided by kuyaph, you expressly agree to comply with and be bound by these Terms in their entirety.

These Terms apply to all Users of the kuyaph platform, including casual visitors, registered members, and VIP players. We reserve the right to modify, amend, or update these Terms at any time without prior notice. Such modifications become effective immediately upon posting to the kuyaph website. Your continued use of the Platform following any changes constitutes your acceptance of the modified Terms. 2. Eligibility and Account Registration

2.1 Age and Legal Requirements

You must be at least twenty-one (21) years of age to create an account or use any Services on the kuyaph platform. This age requirement aligns with Philippine regulations governing online gaming activities and is strictly enforced. By registering an account, you represent and warrant that you are of legal age and possess the legal capacity to enter into this binding agreement.

You further represent and warrant that online gaming is legal in your jurisdiction of residence and that you are not accessing the Platform from any location where online gaming is prohibited by law. It is your sole responsibility to ensure compliance with all applicable local, state, and national laws regarding online gaming activities. kuyaph bears no liability for Users who access the Platform in violation of applicable laws in their jurisdiction.

2.2 Account Creation and Verification

To access certain features and Services on kuyaph, you must create an account by providing accurate, current, and complete information as requested during the registration process. You agree to provide only truthful information, including but not limited to your full legal name, date of birth, residential address, valid email address, and phone number. Providing false, misleading, or fraudulent information during registration constitutes a material breach of these Terms and may result in immediate account suspension or termination without refund of any funds.

kuyaph reserves the right to request identity verification documents at any time, including government-issued identification, proof of address, or payment method verification, to comply with regulatory requirements and prevent fraud. You agree to promptly provide such documentation upon request. Failure to complete verification procedures within the timeframe specified by kuyaph may result in account suspension and restriction of withdrawal privileges until verification is satisfactorily completed.

2.3 Account Security and Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree not to share your login information with any third party and to take all reasonable steps to prevent unauthorized access to your account. You must immediately notify kuyaph of any suspected unauthorized use of your account or any other security breach.

You acknowledge and agree that you are fully responsible for all activities that occur under your account, whether authorized by you or not. kuyaph shall not be liable for any losses, damages, or unauthorized transactions resulting from your failure to maintain account security. In the event of suspected unauthorized account access, kuyaph reserves the right to suspend your account pending investigation and resolution of the security matter.

3. Gaming Services and Conduct

3.1 Service Availability

kuyaph provides access to various online gaming services including but not limited to slot games, live dealer casino games, table games, fishing games, bingo, sports betting, and other entertainment offerings (collectively, "Gaming Services"). We strive to maintain continuous Platform availability; however, we do not guarantee uninterrupted or error-free access to Services. kuyaph reserves the right to modify, suspend, or discontinue any Gaming Services, in whole or in part, temporarily or permanently, with or without notice, for maintenance, updates, technical issues, or any other reason at our sole discretion.

You acknowledge that temporary service interruptions may occur due to factors beyond our reasonable control, including internet service provider failures, telecommunications network problems, force majeure events, or third-party provider outages. kuyaph shall not be liable for any losses, damages, or inconvenience resulting from service unavailability, provided such unavailability results from circumstances beyond our reasonable control.

3.2 Fair Play and Prohibited Activities

All Users must conduct themselves in accordance with fair play principles and ethical standards. The following activities are strictly prohibited and constitute material breaches of these Terms:

• Using automated systems, bots, scripts, or software to manipulate gameplay, exploit vulnerabilities, or gain unfair advantages
• Colluding with other Users to manipulate game outcomes or defraud the Platform or other players
• Exploiting software errors, bugs, or glitches for personal gain rather than reporting them to kuyaph
• Using stolen, fraudulent, or unauthorized payment methods for deposits or transactions
• Creating multiple accounts to circumvent Platform limitations, abuse bonuses, or engage in fraudulent activity
• Engaging in money laundering, terrorist financing, or other illegal financial activities through the Platform
• Reverse engineering, decompiling, or attempting to derive source code from any Platform software
• Harassing, threatening, or abusing other Users, customer support staff, or any kuyaph personnel
• Sharing account access with third parties or allowing others to use your account
• Attempting to manipulate odds, game results, or random number generators through any means

Violation of fair play standards may result in account suspension, forfeiture of winnings, confiscation of account balances, termination of account privileges, and potential legal action. kuyaph reserves the right to investigate suspicious activities and cooperate with law enforcement authorities when illegal conduct is suspected.

3.3 Game Rules and Outcomes

Each game available on the kuyaph platform operates according to specific rules, paytables, and mechanics. It is your responsibility to familiarize yourself with the rules of any game before placing wagers. Game rules are accessible within each game interface or through our help documentation. kuyaph is not responsible for losses resulting from your misunderstanding of game rules or mechanics.

All game outcomes on kuyaph are determined by certified Random Number Generators (RNGs) or, in the case of live dealer games, by actual physical game apparatus operated by professional dealers. Game results are final and binding. kuyaph reserves the right to void game results if technical malfunctions, software errors, or manipulation is detected. In such circumstances, affected wagers will be refunded to player accounts.

4. Financial Transactions

4.1 Deposits

You may fund your kuyaph account through approved payment methods including GCash, PayMaya, bank transfers via BPI, BDO, Metrobank, and other Philippine banks, as well as credit and debit cards. All deposits are processed in Philippine Pesos (PHP) unless otherwise specified. Minimum and maximum deposit limits apply and may vary based on payment method and account status.

You represent and warrant that all funds deposited to your kuyaph account are obtained legally, belong to you, and are not derived from illegal or fraudulent activities. kuyaph reserves the right to refuse deposits, freeze accounts, or report suspicious transactions to relevant authorities if money laundering or illegal funding sources are suspected. Deposits are non-refundable except in cases where kuyaph determines a genuine error has occurred or where required by law.

4.2 Withdrawals

You may request withdrawal of funds from your account balance at any time, subject to verification requirements, minimum withdrawal limits, and any applicable wagering requirements attached to bonuses. Withdrawals are processed to the same payment method used for deposit whenever possible. Processing times vary by payment method but typically range from several minutes for e-wallets to several business days for bank transfers.

kuyaph reserves the right to conduct additional verification procedures before processing withdrawals, including but not limited to requesting identity documents, proof of address, payment method verification, or source of funds documentation. Withdrawals may be delayed or declined if verification is incomplete, if fraudulent activity is suspected, or if Terms violations are detected. Maximum withdrawal limits may apply based on account verification level and VIP status.

4.3 Fees and Currency

kuyaph does not charge fees for deposits or withdrawals; however, third-party payment processors may impose their own fees, which are beyond our control. All transactions are processed in Philippine Pesos (PHP). Exchange rate fluctuations are not the responsibility of kuyaph.

5. Bonuses and Promotions

5.1 Bonus Terms

kuyaph offers various bonuses, promotions, and rewards programs to enhance the gaming experience ("Promotional Offers"). All Promotional Offers are subject to specific terms and conditions, including wagering requirements, time limits, eligible games, and maximum bet restrictions. These specific terms are communicated at the time of each promotion and form part of these Terms by reference.

Unless otherwise stated, all bonuses are subject to wagering requirements that must be fulfilled before withdrawal of bonus funds or winnings derived from bonus funds is permitted. Wagering requirements specify the multiple of bonus amount or combined deposit and bonus amount that must be wagered before funds become withdrawable. Different games contribute differently toward wagering requirements, with contribution percentages specified in each promotion's terms.

5.2 Bonus Abuse and Forfeiture

kuyaph reserves the right to withhold, cancel, or forfeit any Promotional Offer if we determine that you have engaged in bonus abuse or violated promotional terms. Bonus abuse includes but is not limited to creating multiple accounts to claim bonuses repeatedly, irregular betting patterns designed to circumvent wagering requirements, or any activity deemed by kuyaph to be contrary to the spirit of the promotion.

Promotional Offers are intended for recreational players only. Professional gamblers, advantage players, or individuals engaging in systematic exploitation of promotional mechanics may have bonuses cancelled and accounts closed without warning. All decisions regarding bonus eligibility, abuse, and forfeiture are made at kuyaph's sole discretion and are final.

6. Intellectual Property Rights

All content, materials, software, graphics, logos, trademarks, service marks, and other intellectual property displayed on or accessible through the kuyaph platform ("Platform Content") are the exclusive property of kuyaph or our licensors and are protected by Philippine and international copyright, trademark, and intellectual property laws. You acknowledge that kuyaph and its licensors retain all rights, title, and interest in and to all Platform Content.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the kuyaph platform and Platform Content solely for personal, non-commercial entertainment purposes in accordance with these Terms. This license does not grant you any ownership rights in Platform Content. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Platform Content except as expressly permitted by these Terms or with prior written consent from kuyaph.

7. Limitation of Liability and Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KUYAPH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, SYSTEM FAILURE, OR ANY OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF KUYAPH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. KUYAPH DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, kuyaph's liability shall be limited to the greatest extent permitted by law. In no event shall kuyaph's aggregate liability to you for all claims arising out of or related to these Terms or your use of the Services exceed the amount of deposits made by you to your kuyaph account during the six (6) months immediately preceding the claim.

8. Dispute Resolution and Governing Law

These Terms and any disputes arising out of or related to these Terms or your use of kuyaph Services shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the competent courts of Metro Manila, Philippines, and you hereby consent to the personal jurisdiction and venue of such courts.

Before pursuing formal legal action, you agree to first attempt to resolve any disputes informally by contacting kuyaph customer support and providing a detailed description of the dispute, the resolution you seek, and your account information. kuyaph will make reasonable efforts to resolve disputes amicably within thirty (30) days of receiving notice. If the dispute cannot be resolved informally, either party may pursue formal legal remedies.

9. Account Termination and Suspension

kuyaph reserves the right to suspend or terminate your account and refuse all current or future use of the Services, in whole or in part, at our sole discretion, with or without cause, and with or without notice, for any reason including but not limited to:

• Violation of these Terms or any applicable laws or regulations
• Fraudulent, suspicious, or illegal activity
• Failure to provide required verification documentation
• Abuse of bonuses, promotions, or gaming mechanics
• Prolonged account inactivity
• Requests by regulatory or law enforcement authorities
• Risk management concerns
• Any conduct that kuyaph deems inappropriate or harmful to the Platform or other Users

Upon termination for cause, kuyaph reserves the right to forfeit any remaining account balance, winnings, or bonuses. Upon termination without cause or upon voluntary account closure by you, kuyaph will return any remaining withdrawable balance in your account, subject to standard withdrawal procedures and verification requirements. You acknowledge that termination may result in loss of all account content, data, and information associated with your account, and kuyaph has no obligation to maintain or provide copies of such information.

10. General Provisions

10.1 Entire Agreement

These Terms, together with our Privacy Policy and any specific promotional terms referenced herein, constitute the entire agreement between you and kuyaph regarding your use of the Services and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter hereof.

10.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, such provision shall be severed from these Terms. The validity, legality, and enforceability of the remaining provisions shall not be affected or impaired thereby.

10.3 Waiver

No waiver by kuyaph of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by kuyaph to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

10.4 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of kuyaph. kuyaph may assign, transfer, or delegate its rights and obligations under these Terms without restriction and without notice to you. Any attempted assignment by you in violation of this section shall be null and void.
